Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, directing the respondents 3 and 4 herein to survey the lands, situated in Yethapur Village, Pethanaickenpalayam Taluk, Salem District, with the help and assistance of the 5th respondent Police Station, as per the Application Nos.2026/0123/08/00512 dated 30.01.2026, 2026/0123/08/01618 dated 24.03.2026 and 2026/0123/08/01768, dated 04.04.2026 submitted by the petitioner to the respondents 3 and 4 as per his title deeds viz., sale deed dated 04.05.1959, registered as Doc.No.1537/1959 at the Sub Registrar Office, Vazhapadi, Deed of Settlement dated 28.12.2001, registered as Doc.No.2247/2001 at the Sub Registrar Office, Pethanaickenpalayam and Sale Deed dated 22.02.2002, registered as Doc.No.303 of 2002 at the Sub Registrar Office, Pethanaickenpalayam, by considering the petitioner's representation, dated 09.03.2026 to the 1st respondent.

ORDER

This Writ Petition is filed seeking to direct the respondent Nos.3 and 4 to survey and demarcate the property, based on his online application, dated 04.04.2026, with the assistance of the fifth respondent, within a time frame to be fixed by this Court.

2. The petitioner had submitted an application through on-line on 04.04.2026 for the aforesaid purpose. Since the same was not considered, the petitioner has filed this writ petition.

3. Mr.R.P.Murugan Raja, learned Government Advocate, accepts notice on behalf of the respondent Nos.1 to 4 and Mr.V.Meganathan, learned Government Advocate (Crl.Side), accepts notice on behalf of the fifth respondent. Since no adverse orders are passed against the respondent Nos.6 to 12 in this Writ Petition, notice to the respondent Nos.6 to 12 is dispensed with by this Court.

4. No prejudice will be caused to the respondents, if the fourth respondent is directed to survey and demarcate the boundaries of the petitioner's property more fully disclosed in the prayer to this Writ 3/6

Petition, after hearing the objections, if any, from the respondent Nos.6 to 12, the neighbouring land owners as well as any other party whom they deem fit to put on notice within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the fourth respondent is directed to issue notice to the fifth respondent, the neighbouring land owners, and also to any other party, if they deem fit to put on notice. (b) After receiving objections if any and after considering the same, the third respondent shall conduct survey and demarcate the boundaries of the property more fully disclosed in the prayer to this Writ Petition, on merits and in accordance with law, within a period of twelve

(12) weeks from the date of receipt of a copy of this order. (c) If the need arises for police assistance and on a request made by the fourth respondent, the fifth respondent shall render police assistance for the effective implementation of this order. (d) There shall be no order as to costs.
