ORDER
This Criminal Original Petition has been filed by the petitioner to quash the FIR in Crime No.164 of 2017 on the file of the Inspector of Police, Civil Supplies CID, Kancheepuram, Kancheepuram District, registered against the petitioner for the offences under Sections 6(2), (3) of Tamil Nadu Scheduled Commodities (RDCS) Order, 1982 and Section 7(1)(a)(ii) of Essential Commodities Act, 1955 for the alleged shortage of stock to the tune of Rs.58,387/- occurred in the year 2017, while the petitioner was working as a Salesman in Karaimanagar Fair Price Shop.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the first respondent police and also perused the materials available on record.
3. Since no adverse order is being passed against the second respondent, notice to the second respondent is dispensed with. 2/5
4. A reading of the FIR shows that there are prima facie allegations against the petitioner. Therefore, this Court is not inclined to quash the FIR.
5. Further, the FIR has been registered way back in the year 2017. Therefore, the first respondent police is directed to complete the investigation and file the charge sheet within a period of two months from today failing which, the Director of Civil Supplies is directed to take action against the concern Investigating Officer and file a report before this Court on or before 18.08.2025.
6. With the above directions, this Criminal Original Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed.
