Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the 2nd and 3rd respondents herein to consider the representation dated 18.05.2016 and reminder representation dated 13.06.2016 to correct and rectify the mistake in FMB Sketch in bearing S.No.583/1 and 483/5 situated in Siruvachur Village, Attur Taluk, Salem District within a time frame to be fixed by this Court.

By consent, the writ petition is taken up for final disposal.

The petitioner claims that his father, viz., Ramasamy, was in possession and enjoyment of the ancestral properties in S.Nos.583/1 and 5, situated at Siruvachur Post, Attur Taluk, Salem District, through a registered Partition Deed dated 16.06.1994 and after the demise of his father, the petitioner is possession and enjoyment of the same. According to the petitioner, in all the revenue records, the name of the petitioner is reflected in respect of the said land and he is https://hcservices.ecourts.gov.in/hcservices/

also issued with pattas bearing Nos.818 and 866. The grievance expressed by the petitioner is that in the Field Measurement Book [FMB] Sketch, some mistake had crept in and in this regard, the petitioner submitted a representation dated 13.06.2016 to the respondents and since no response is forthcoming, he is constrained to approach this Court, by filing the present writ petition.

Heard the submissions of the learned counsel for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader who accepts notice on behalf of the respondents. Though the petitioner has prayed for a larger relief, this Court, in the light of the facts and circumstances and without going into the merits of the same, directs the 4th respondent to consider and dispose of the petitioner's representation dated 13.06.2016 on merits and in accordance with law, after putting on notice the person/s concerned and pass orders within a period of ten weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the person/s concerned.

The writ petition is disposed of with the above direction. No costs.
