O R D E R
The writ petition is filed for a mandamus, directing the respondents issue legal heirship certificate to the deceased brother of the petitioner, namely, P.Shankar son of Panchasharam, who died on 20/10/2024.
2. According to the petitioner, she is the sister of the said Thiru.P.Shankar. The said Thiru.P.Shankar was originally married but got divorced before his date of death. When the petitioner tried to make an application through online portal, because the marital status is shown as 'married', the online portal is not accepting the application.
3. When the matter came up for hearing, the Learned Additional Advocate General for the respondents on written instructions would submit that 2/5
if only suitable changes are made in the software for submitting the application, such cases can be considered.
4. I have considered the rival submissions made on either side and perused the material records of the case.
5. As a matter of fact, considering the similar facts and circumstances, this Court has already passed directions to suitably make alterations to the online portal and also to make additions to Government Order in this regard in W.P.No.15721 of 2025. The same shall considered by the respondents.
6. As far as the present case is concerned, this writ petition is disposed of on the following terms (i). Treating it as an extraordinary case, the petitioner's physical application shall be received and processed in the manner known to law and the legal heirship certificate shall be issued as per law. 3/5
(ii) Along with the web copy of the order, the petitioner shall make a fresh application within one week from the date of receipt of the web copy of the order. Upon receipt of the application, the same shall be considered by the second respondent in accordance with law and final orders be passed after enquiry, within a period of 12 weeks from the date of receipt of the application There shall be no order as to costs.
