Petition seeking bail in respect of S.C.No.10 of 2026 pending on the file of the Principal Sessions Judge, Thiruvarur District, in connection with Crime No.245 of 2025 registered for the offences punishable under Sections 296(b), 118(1), 109 and 103 of the BNS , is on board for consideration. 1/6

The learned counsel for the petitioner/A3, pleading innocence on the part of the petitioner, who has been in incarceration since 29.07.2025 and false implication in the case, seeks indulgence of this Court. He also submits that there was no prior enmity between the petitioner and the deceased and that the incident occurred due to sudden provocation during a quarrel. He further submits that the investigation in this case has been completed and the charge sheet has also been filed. He also submits that the co-accused was granted bail by this Court on 28.04.2026 in Crl.O.P.No.10506 of 2026.. He further submits that the petitioner is ready to abide by any stringent condition that may be imposed by this court. 3.
The case of the prosecution as put forth by the learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing the grant of bail, is that it is a case of murder of two innocent individuals by the accused. He further submits that a quarrel ensued between the accused and one Gopikrishnan and upon the latter raising an alarm, the victim/deceased persons intervened to assist him. At that time, the petitioner, along with other accused, abused the deceased persons in filthy language and attacked them with a knife. Though the victims were taken to hospital, they succumbed to their injuries without responding to the treatment. He further submits that the case now stands 2/6
posted to 05.06.2026 for framing of charges and that there is no previous case against the petitioner.

Having heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent police and perused the materials available on record and considering the period of incarceration undergone by the petitioner and also the fact that the co-accused was granted bail, this Court is inclined to grant bail to the petitioner with certain conditions and accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruvarur, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioner shall appear before the trial Court on all working days at 10.30a.m., until further orders; [c] the petitioner shall not abscond during trial; [d] the petitioner shall not tamper with evidence or witness during trial;
[e] On breach of any of the aforesaid conditions, the 3/6
learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
