When the matter was taken up for hearing, the learned counsel appearing for the appellant submitted that, since the appellant and 1st respondent are brothers, the matter has been compromised out of the Court. Hence, he seek the permission of this court to withdraw the above Second Appeal, and he has also made endorsement to that effect.

2. In view of the submission and endorsement made by the learned Counsel appearing for the appellant, this Second appeal is dismissed as withdrawn. Consequently, connected Miscellaneous petition is closed. No costs.
