This application has been filed seeking amendment of the cause title, to amend the description of the defendants 5 and 6.

2. The defendants 5 and 6 have been described in the original plaint as follows:-

5. Sun Life Rep. by its Managing Director M.R.C.Nagar, Chennai - 600 028.

6. K TV Rep. by its Managing Director M.R.C.Nagar, Chennai - 600 028.

3. The defence taken by the defendants 5 and 6 that the defendants 5 and 6 did not have any independent existence and they are only channels forming part of the Company called Sun TV Networks Limited. Page No.1/4

4. In view of the said defence, the amendment is sought for by the plaintiffs seeking to describe the defendants 5 and 6 as follows:- 5."Sun TV Network Limited (Corporate Office) Sun Life a Unit of Sun TV Network Rep by its Chief Executive Officer Murasoli Maran Towers 73, MRC Nagar Main Road, MRC Nagar, Chennai - 600 028."

6. "Sun TV Network Limited (Corporate Office) K TV a Unit of Sun TV Network Rep by its Chief Executive Officer Murasoli Maran Towers 73, MRC Nagar Main Road, MRC Nagar, Chennai - 600 028."

5. Heard Mr.K.Elango, learned counsel appearing for the petitioners and Mr.M.A.Vimalmohan, learned counsel appearing for the respondents 5 and 6.

6. Mr.M.A.Vimalmohan, learned counsel appearing for the respondents 5 and 6 would submit that even the amended cause title is not correct. It would be suffice if the Sun TV Network Limited is a party defendant and it is shown that Sun Life and KTV are the channels Page No.2/4

belonging to the Sun TV Network.

7. In view of the stand so taken by the counsel for the respondents 5 and 6, this amendment application is allowed and the amendment sought for is modified and allowed as follows:- ➔The 5th defendant will be described as

5. Sun TV Network Ltd., (Broad casting as Sun Life and K TV) Represented by its Chief Executive Officer Murasoli Maran Towers 73, MRC Nagar Main Road, MRC Nagar, Chennai - 600 028.

➔The 6th defendant will stand deleted from the array of parties.

8. The learned counsel for the plaintiffs to carryout amendment and file amended copy of the pleadings by 26.08.2021. 12.08.2021 dsa R.SUBRAMANIAN,J.
