The petitioner/A2, who was arrested and remanded to judicial custody on 06.02.2024, pursuant to the Non-Bailable Warrant of arrest issued against him in S.C.No.39 of 2020 pending on the file of the learned I Additional District and Sessions Judge, Thiruvallur in connection with Crime No.123 of 2019 registered for the offences under Sections 294(b), 307, 323 and 302 of IPC, seeks bail.

Learned counsel for the petitioner submitted that this is the second application for bail filed by the petitioner and the earlier bail application was dismissed by this Court in Crl.O.P.No.10565 of 2024 vide order dated 29.04.2024. He further submitted that since the petitioner failed to appear before the trial Court, he was issued with the non-bailable warrant of arrest and pursuant to the same, he was arrested on 06.02.2024. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and therefore, he prayed for grant of bail to the petitioner.
3. Learned Government Advocate (Crl.Side) appearing for the respondent submitted raised objection stating that this is the second application for bail filed by the petitioner. He further submitted that the petitioner is a native of Assam and pursuant to the NBW issued by the trial Court, he was secured in Assam with great difficulty only on 06.02.2024, therefore, if he is released on bail, there is a possibility of him absconding again and will not available for trial. Hence, he raised objection for allowing the petition.

4. Taking into consideration the facts and circumstances of the case, the submissions made by the learned Government Advocate (Crl.Side) and also considering the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.
5. Accordingly, the Criminal Original Petition stands dismissed.
