P.VELMURUGAN .,J While disposing of this Criminal Original Petition, this Court vide order dated 22.12.2021, directed the trial court to proceed with the trial and complete the same within three months from the date of receipt of a copy of the order. Pursuant to the letter received from the Special Judge, Special Court for the Cases under P.C Act seeking extension of time to complete the trial, already this Court vide order dated 03.08.2022 has granted extension of time for further period of four months to complete the trial.
2. Learned Additional Public Prosecutor appearing for the respondent submitted that no stay has been granted in Crl.R.C.No.1543 of 2022.
3. In view of the above, the trial court can proceed with the trial 1/3
in accordance with law without waiting for the outcome of the revision case, unless there is specific stay from the appellate forum or the revision forum. This Court again and again has given direction to the trial court that unless there is specific stay passed by the appellate forum or the revision forum, the trial court need not wait for the result of the revision.
4. This Court condemned the action of the trial court for the non-compliance of the directions of this Court. However, further period of one month is granted to complete the trial and dispose the same, failing which, Registrar General is directed to take action against the presiding officer and report.
