Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a writ of certiorarified mandamus to call for the records of the first respondent pertaining to his letter No.3683/Po.3/2017, dated 19.12.2017 and quash the same and direct the respondents to furnish documents sought for by the petitioner by letter dated 14.06.2017 to enable him to submit explanation before further proceedings in the matter of charge against the petitioner.

The present writ petition is directed against the impugned letter dated 19.12.2017 of the first respondent / the Superintendent of Prison, Central Prison-2, Chennai, refusing to produce certain documents as sought for by the petitioner.

2. When the matter is taken up, learned counsel for the petitioner submitted that, except the document referred in Sl.No.4 of the proceedings dated 23.09.2017 of the first respondent, the petitioner has received all other documents to defend his claim before the Enquiry Officer, therefore, a direction may be given to the first respondent to furnish the said document as well.

3. Mr.R.S.Selvam, learned Government Advocate, by accepting notice for the respondents, sought for one week time to furnish the said document as sought for by the petitioner.

4. Recording the above said statement, this Court hereby directs the respondents to furnish a copy of the document referred in Sl.No.4 of the proceedings dated 23.09.2017 of the first respondent before proceeding further with the enquiry, within a period of one week from the date of receipt of a copy of this order. With this direction, the writ petition is disposed of. No Costs. WMP.No.1753 of 2018 is closed.
