O R D E R
This Contempt Petition has been filed to punish the respondents for having violated the order passed in WP No.26667 of 2018 dated 10.10.2018.
2.This case went several adjournments for hearing. After hearing the learned counsel on either side, on the earlier occasions, this Court came to a
prima facie opinion that the respondents have failed to implement the order of this Court in its true letter and spirit and in order to give one more opportunity to them, this case is adjourned to today.
3. Today, when this matter is taken up, the learned counsel for the respondents has placed a copy of the proceedings dated 23.01.2025 issued by the Director, Adi-dravidar and Tribal Welfare Department, Chennai and submits that the order of this Court is complied with, by the respondents. 4.The learned counsel for the petitioner has also acknowledged the same.
5. However, it is pertinent to note that there is a delay of 6 years in implementing the order of this Court. The Officers are present before this Court today in person and submitted that they are not the concerned Officers at the relevant point of time, however, now they have complied with the order of this Court fully and they are also going to credit the amounts into the account of the petitioner in a couple of days, and hence, they requested this Court to take a lenient view for the delay of 6 years in implementing the
order of this Court.
6.Considering the facts and circumstance of the case and taking into consideration of the submissions made by the respondents, a lenient view is taken by this Court towards the respondents for having complied with the order of this Court with the delay of 6 years and in such view of the matter, no further orders are necessary. Hence, this Contempt petition is closed.
7. However, it is made clear that the respondents will be more cautious and vigilant in implementing the orders of this Court in future in a true letter and spirit and within a time frame as stipulated therein by this Court. This Court places its appreciation on record for the assistance rendered by Mr.L.S.M.Hasan Fizal, who appeared for the respondents. 27.01.2025 dn
