T.V.THAMILSELVI,J., The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148 and 302 of IPC r/w 34 and 201 of IPC, in Crime No.390 of 2024, seeks anticipatory bail.

The case of the prosecution is that one Jeevaraj (A1) and Sophia were in love with each other and one Ranjith who was a resident in the same locality, had one side love affair with the said Sophia. Therefore, the said Ranjith along with his friends, assaulted the said Jeevaraj on his head and based on the complaint given by Jeevaraj, the Ranjith and his friends were arrested and remanded to judicial custody and later they were released on bail. Subsequently, Jeevaraj and Sophia got married. One day, due to triggered enmity, one of the friends of said Ranjith namely Magesh, displayed a video, teasing Jeevaraj (A1) as a coward. On 06.05.2024, the said Jeevaraj (A1) along with two others, came in a motorcycle and enquired about Magesh to his grandmother Backiyam and when the same was questioned by her, Jeevaraj (A1) and two others, assaulted Backiyam with knife and caused her death. Hence, the case.

3.The learned counsel appearing for the petitioner submits that the petitioner is the aunt of Jeevaraj (A1.) She is an innocent and she has been falsely implicated in this case. He further submits that except this case, there is no other case against the petitioner. Hence, prays for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) appearing for the respondent submits that there are totally 7 accused in this case and the petitioner is A6. The specific overt-act against the petitioner is that she helped A1 by giving two-wheeler which was used for the alleged occurrence to commit murder of one Backiyam, who is the grandmother of one Magesh. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration of the above facts and circumstances and also the fact that the petitioner who is the Aunt of A1, has helped A1 to commit the murder of one Backiyam by giving a two wheeler, this Court is not inclined to grant anticipatory bail to the petitioner.
