With the consent of both learned counsels, this writ petition is disposed of at the admission stage itself.
2. Mr.R.Murthi, learned Government Advocate takes notice for the respondents 1 and 2. Dr.T.Seenivasan, learned Special Government Pleader takes notice for the 3rd respondent.
3. Writ petition is filed for a writ of mandamus, directing the respondents to issue a fresh death certificate of the petitioner's father, Mr. Krishnamurthy, after correcting all the typographical errors in his prior death certificate based on his representation, dated 25.02.2025.
4. The petitioner's father late K.Krishnamurthy, son of Kaliyaperumal died on 18.12.1989. The petitioner's father died leaving behind the petitioner, his mother aged 96 years, his two brothers and two sisters as legal heirs. As the petitioner was residing in Chennai, he was not able to apply for the death certificate and legal heir certificate at the appropriate time. The petitioner's aged mother wanted to settle all the family properties in favour of her children, for which, the death certificate of the petitioner's father was necessitated. The petitioner therefore applied for death certificate of his father on 21.04.2024, and 2/6
the same was received by him on 03.07.2024, from the Mayiladuthurai Municipality. However, the petitioner found that there were several typographical errors in the death certificate. The petitioner therefore submitted a representation on 17.10.2024, to the respondents for correcting the typographical errors along with the NOC issued by Mayiladuthurai Municipality. As no action was taken, the petitioner sent further representation on 25.02.2025, to the respondents. The 2nd respondent in pursuance of the petitioner's representation, informed the petitioner to remit Rs.500/- for the purpose of carrying out the corrections. The petitioner remitted the said sum on 25.02.2025, and even thereafter, no action was taken. The petitioner was therefore constrained to file the above writ petition for the aforesaid relief.
5. I heard both the learned counsels and perused the materials placed on record.
6. The facts are undisputed and the issue is whether the petitioner is entitled to a fresh death certificate of his father.
7. According to the petitioner, the petitioner's father name was wrongly mentioned in the death certificate and his age was also wrongly given as 55 3/6
years, instead of 62 years. The petitioner was directed to remit and he remitted a sum of Rs.500/- for carrying out necessary corrections and for issuance of a fresh certificate.
8. The respondents admittedly felt that the errors in the original death certificate needed corrections and for that purpose directed the petitioner to remit Rs.500/-, which the petitioner also remitted. Under the said circumstances, I am inclined to issue a direction to the 2nd respondent to carry out the corrections in the death certificate issued to the petitioner on 03.07.2024, and to issue a fresh certificate to the petitioner, within a period of eight (8) weeks, from the date of receipt of a copy of this order. Writ petition is accordingly allowed. However, there shall be no order as to costs.
