Mrs.S.Pavithra, Standing Counsel Common Order The writ petitions are filed for the below relief: "directing the respondents to disburse the belated payment of interest amount of provident fund, Gratuity and Earned leave salary with effect from respective dates within the stipulated time. ".
2. The brief facts which has culminated in the filing of these writ petitions are set out below:
2.1. It is the case of the petitioners that they were retired employees of the respondent Corporation. The respondents settled their retirement benefits with a delay. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation to the respondents to pay the interest for the belated payment of the petitioners' Provident Fund, Gratuity and Earned Leave Salary. Since there is no response, the petitioners are before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. Admittedly, the Provident Fund, Gratuity and Earned Leave Salary has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same.
(a)Therefore, the Writ petition in W.P.No.17766 of 2026 is allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund, Gratuity and Earned Leave Salary with effect from 01.03.2025 within a period of one (1) month from the date of receipt of a copy of this order. No costs.
(b)Therefore, the Writ petition in W.P.No.17771 of 2026 is allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund, Gratuity and Earned Leave Salary with effect from 01.06.2025 within a period of one (1) month from the date of receipt of a copy of this order. No costs. (c)Therefore, the Writ petition in W.P.No.17773 of 2026 is allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund, Gratuity and Earned Leave Salary with effect from 01.07.2025 within a period of one (1) month from the date of receipt of a copy of this order.
