The instant writ petition has been filed seeking the relief of writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 16.12.2024 and consequently direct the respondents to rectify the date of birth of the petitioner as 22.05.1975 instead of 22.05.1971 and to pass an appropriate orders on merits in accordance with law within a time frame fixed by this Hon'ble Court.
2. Heard Mr.J.Arun Prasad, learned counsel for the petitioner and Mr.S.Manikandan, learned Standing counsel appearing on behalf of the respondents.
3. The learned counsel for the petitioner would submit that the petitioner has come up with a prayer to consider his representation dated 16.12.2024, which had been given to correct his date of birth in the service records.
4. According to the learned Standing Counsel, as per Section 59 of the 2/4
Tamil Nadu Government Servants [conditions of service] Act, within 5 years from the date of joining service, if any grievance in respect of their date of birth, an application has to be given to change the same. However, in this case, according to the learned standing counsel, the petitioner had joined during 1999 and has given application only during 2009. Furthermore, it is the submission of the petitioner that earlier representation of the petitioner was already rejected on 19.10.2020. In such view of the matter, this Court does not find any merits in this writ petition.
5. In the result, this writ petition is dismissed. However, the petitioner is at liberty to challenge the order dated 19.10.2020 in accordance with law. There shall be no order as to costs.
