The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 498A and 406 of IPC in Crime No.09 of 2024, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant is the wife of the petitioner. They got married in the year 2014 and a male child born to them in the year 2020. Due to some misunderstanding, the defacto complainant stayed in her mother's house. In the meanwhile, the petitioner married another woman. Hence, the complaint.

3. The learned counsel appearing for the petitioner submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would submit that he has been falsely implicated in this case. He would also submit that the defacto complainant has given this complaint only to harass the petitioner. Hence, he prays for grant of anticipatory bail to the petitioner.

gsk complainant are husband and wife. The petitioner married another woman, thereby cheated the defacto complainant. The photographs of the marriage of the petitioner with another woman is also produced before this Court. Hence, he opposed for grant of anticipatory bail to the petitioner.

Considering the facts and circumstances of the case and also considering the submissions made by the learned counsel on either side, and also considering the fact that the petitioner married another woman, this Court is of the view that this case needs detailed investigation and not inclined to grant anticipatory bail to the petitioner.
