... Respondents / Respondents This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.F. Terry Chella Raja, learned counsel for the Appellant/claimant and Mr.D.Baskaran, learned counsel for the 2nd respondent/Insurance Company are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.1,03,000/- [Rupees One Lakh and Three Thousand Only], together with interest at 7.5% per annum, from the date of petition i.e. 02.12.2011 till the date of realization, payable by the 2nd respondent at the first instance with a liberty to recover the same from the first respondent, without filing any separate application. Aggrieved by the award of the Tribunal, the appellant/claimant preferred the present appeal. 2.

After due deliberation and consultation, both the parties have agreed to settle the award to a sum of Rs.75,000/- (Rupees Seventy Five Thousands Only), over and above the award amount of the Tribunal, as full quit compensation.

The second respondent/ insurance company is directed to deposit the amount of Rs.75,000/- (Rupees Seventy Five Thousands Only), now arrived today, within a period of six weeks from the date of receipt of a copy of this order, in M.A.C.T.O.P.No.5157 of 2011 on the file of the Motor Accident Claims Tribunal, Special Judge No.1, (Motor Accident Claims Petitions), Small Causes Court, Chennai and on such deposit, the appellant/claimant is directed to withdraw the same.

The Tribunal is directed to transfer the amount through RTGS/NEFT to the party concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. 5.

The Civil Miscellaneous Appeal is disposed of accordingly. Consequently, connected civil miscellaneous petition, if any stands closed. No costs.

Counsel for the 2nd respondent This Lok Adalat award is passed in terms of the above settlement. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
