ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a writ of mandamus to direct the 3rd respondent to transfer the patta in favour of petitioner in respect of land comprised in S.No.246/1B2, measuring an extent of 1 acre 46 cents, S.No.246/2, measuring an extent of 11 cents and S.No.455/2E, measuring an extent of 1 acre 11 cents situated at Uthanapalli Village, Soolagiri Taluk, Krishnagiri District by considering the petitioner's application dated 20.06.2024 and 21.06.2024. 3.It is submitted by the learned counsel for petitioner that the petitioner purchased the above mentioned property on 21.08.1993 from Seenappa, Rajappa, K.S.Narayana and Munilachumamma vide Sale Deed registered as Document No.936 of 1993 before the Sub Registrar, Rayakottai. The property in respect of S.No.246/1 sub divided into new S.No.246/1B2. It is further submitted that petitioner made applications 2/6
dated 20.06.2024 and 21.06.2024 seeking transfer of patta in his favour. However, the same has not been considered by the 3rd respondent. Aggrieved by the same, petitioner has come before this Court. 4.At the outset, learned Special Government Pleader for respondents would submit that the applications dated 20.06.2024 and 21.06.2024 would be considered and appropriate orders passed in accordance with law within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner. 5.
In view thereof, considering the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the 3rd respondent, to consider the applications made by the petitioners on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner and any other interested parties/stake holders, within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the applications and it is open to the concerned respondent to consider the applications on its own merits and in accordance with law. No costs.
