2. During the pendency of the suit, very unfortunately the person, who has been representing the plaintiff in the judicial proceedings Mr.R.Surendran has expired.

3. This application has now been filed seeking to substitute him with Mr.S.Vijayakumar,S/o.R.Surendran. In the application, it has been stated that Mr.S.Vijayakumar may be substituted for R.Surendran in the relevant paragraphs, in the short cause title, the long cause title and in the statement of addresses, and also wherever mentioned in the plaint.

4. Heard the learned Senior counsel for the respondent/defendant.

5. In view of the fact that by this amendment that there is no shift in the cause of action and there no material change in the nature of the pleadings as framed in the plaint, the application is allowed. 1/2 http://www.judis.nic.in

6. Registry is directed to carry out the necessary amendment by substituting the name Mr.S.Vijayakumar in the place of Mr.Surendran, wherever found in the plaint.

7. Registry may carry out such amendment, and the learned counsel may file an amended copy of the plaint and also serve it on the learned counsel for the defendants.
