J U D G M E N T

The learned counsel appearing for the appellant would submit that the sole appellant died on 16.01.2006. However, even after repeated reminders, the legal heirs of the deceased sole appellant have not come forward with the proper application.

2. The learned counsel appearing for the appellant has filed a memo and produced the letter to that effect.

3. In view of the memo filed by the appellant, the second appeal is dismissed as abated. No Costs.
