The petitioners seek for a Mandamus to direct the 2nd and 3rd respondents to register the sale deed dated 30.09.2016.
2. Heard the learned counsel for the petitioners and the learned Special Government Pleader appearing for the respondents.
3. It appears that the petitioners presented the sale deed dated 30.09.2016 before the 3rd respondent on 03.10.2016 for registering the same. It is stated that the 3rd respondent has neither registered the document nor returned the same with any endorsement so far and therefore, the petitioners have approached this Court and filed the present writ petition with the relief as stated supra.
4. Needless to say that once the document is presented, the 3rd respondent has to proceed with in accordance with law and decide as to whether the same is required to be registered or to be returned if it is found that there is some legal impediment for registering the same by the 3rd respondent. It appears that the 3rd respondent has not done either of the above said two actions. On the other hand, it is stated, the 3rd respondent is keeping quite all these days.
5. Therefore, this writ petition is disposed of only with a direction to the 3rd respondent to consider the sale deed dated 30.09.2016 presented by the petitioner on 03.10.2016 and take appropriate action on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
