Mr.P.Elayarajkumar, Govt. Counsel for R1 to R6 Order This Writ Petition has been filed challenging the proceedings in Na.Ka. No.9337/ A2/ 2025 dated 16.12.2025, passed by the fourth respondent.

2. The fourth respondent issued the impugned order seeking recovery of sums extended by way of loan to the petitioner. It is the case of the petitioner that the petitioner is a visually challenged person. He had never applied or

obtained any loan. He would further state that the seventh respondent had obtained loan in the name of the petitioner without his consent. The present recovery proceedings is only with respect to the said loan which apparently has been obtained by the seventh respondent without the consent of the petitioner.

3. It is submitted by the learned counsel for the petitioner that a criminal proceedings has also been initiated as against the seventh respondent. In the meanwhile, the recovery proceedings are initiated against the petitioner with respect to the said loan. He would further submit that the impugned order has been passed without putting the petitioner on notice.

4. The learned Government Counsel for the respondents on the other hand pointed out that the summon has been issued and the petitioner had in fact appeared and offered his explanation.

5. On perusal of the impugned order, it is seen that there is no reference about the explanation so offered by the petitioner, much less being considered. In such view of the matter, this Court is inclined to set aside the impugned order.

6. Accordingly, this Writ Petition is disposed of and the impugned order dated 16.12.2025 is set aside and the fourth respondent is directed to afford an

opportunity of hearing to the petitioner and pass orders afresh within a period of two weeks from the date of receipt of a copy of this order. The recovery proceedings shall be kept in abeyance until then. No costs.
