ORDER
The petitioner/wife seeks transfer of HMOP.No.18 of 2023 pending on the file of the Sub Court, Arakkonam, Ranipet District to the file of the VI Additional Family Court, Chennai to be heard along with HMOP.No.2177 of 2024.
2. Learned counsel for the petitioner/wife submits that, the petitioner is residing in Kodambakkam, Chennai and it would be very much inconvenient for the petitioner to attend the HMOP proceedings before the Sub Court, Arakkonam, Ranipet District, in view of the long distance to be travelled by he. Learned counsel further submits that, the petitioner/wife has also filed a petition under Section 9 of the Hindu Marriage Act, seeking restitution of conjugal rights in HMOP.No.2177 of 2024 before the VI Additional Family Court, Chennai and in view of the parties being same, in order to avoid multiplicity of proceedings and conflicting orders, in the interest of justice, it would suffice, if this Court orders transfer of HMOP.No.18 of 2023 to the file of the VI Additional Family Court, Chennai to be heard along with HMOP.No.2177 of 2024. 3. Learned counsel for the respondent/husband fairly submits that the respondent/husband has no serious objection for transfer of the said HMOP proceedings to the file of the VI Additional Family Court, Chennai to be tried along with HMOP.No.2177 of 2024.
4. I have heard the learned counsel on either side and I have also perused the affidavit filed in support of this transfer petition.
5. In the light of the above submissions made by the learned counsel for the parties, this Transfer Civil miscellaneous petition stands allowed and the case in HMOP.No.18 of 2023 is withdrawn from the file of the Sub Court, Arakkonam, Ranipet District and the same is transferred to the file of the VI Additional Family Court, Chennai to be tried along with HMOP.No.2177 of 2024. No costs. Consequently, the connected miscellaneous petition is closed.
