The present Criminal Miscellaneous Petition has been filed praying to extend the time granted for filing final report in Crime No.187 of 2019 pending on the file of the first petitioner police. 2.In earlier occasion, on 03.03.2020, while at the time of disposing the Crl.O.P.No.28113 of 2019, this Court directed the first petitioner police to file final report in Crime No.187 of 2019 within a period of twelve weeks from the date of receipt of a copy of this order. In this regard, today when the petition is came up for hearing, both the counsel appearing for the first petitioner police and the respondents are present. 3.The learned Additional Public Prosecutor appearing for the first petitioner police would submit that the respondents in this petition have filed Special Leave Petition before the Hon'ble Apex Court wherein they challenged the order passed by this Court in Crl.O.P.No.28113 of 2019. Therefore, the first petitioner police is not in a position to file final report as 1/3
directed by this Court. Hence, the learned Additional Public Prosecutor appearing for the first petitioner police seeks time for filing final report. 4.In respect of the contention raised by the learned Additional Public Prosectuor regarding the Special Leave Petition, the learned Counsel appearing for the respondents fairly conceded the same and it is brought to the notice of this Court that the first petitioner police have also filed counter in the Special Leave Petition.
5.Therefore, in view of the said submissions, it is a fit case to extend the time granted for filing final report. Accordingly, this Petition is ordered and the time already granted to the first petitioner police for filing final report in Crime No.187 of 2019, is extended for a period of four months from the date of receipt of a copy of this order. 21.12.2020 ay R.PONGIAPPAN, J.
