The petitioner has come up with this writ petition for a mandamus, directing the respondent to release 840 bags of rice each weighing 25 kg (210 Quintals) seized from a Lorry bearing Registration No.AP-26-TC-0349 by the Inspector of Police, Civil Supplies CID, Vellore, Vellore District on 08.05.2017, to the petitioner on furnishing immovable property as security.

According to the learned counsel for the petitioner, on the basis of the orders placed by one Yuvaraja Traders, APMC Yard, Bangarpet, Karnataka State, the petitioner transported rice weighing 210 quintals in a Lorry bearing Registration No.AP-26-TC-0349, under way bill and invoice dated 08.05.2017, which was seized by the Inspector of Police, CSCID, Vellore and was produced before the respondent. Claiming the transportation as valid and supported by proper documents, the petitioner made a representation dated 24.11.2017 to the respondent, for https://hcservices.ecourts.gov.in/hcservices/

releasing the rice bags on furnishing immovable property security. Since the said representation was not considered by the respondent, the petitioner is before this Court.

When the matter is taken up for consideration, the learned Additional Government Pleader appearing for the respondent, on instructions, submitted that the enquiry proceedings has been commenced by the respondent, for which, the presence of the petitioner is required and on completion of the enquiry the respondent would pass orders on merits.

4. In reply, the learned counsel appearing for the petitioner submitted that the petitioner is ready and willing to appear for enquiry before the respondent.

5. In order to give quietus to the issue involved, this Court directs the petitioner to appear before the respondent for enquiry on 08.10.2018 and on such appearance, the respondent shall conduct the enquiry and pass appropriate orders with regard to release of the rice bags, on merits and in accordance with law, within a week thereafter.
