This Petition has been filed to condone the delay of 160 days in filling the restoration petition to restore the S.A.No.1195 of 2008 which was dismissed for default on 27.11.2023.

2. Heard the learned counsel for the petitioners and learned counsel for the respondents and perused the material available in the record.

3. On being satisfied with the averments stated in the affidavit filed in support of the petition and to avoid multiplicity of proceedings, this Court is inclined to condone the delay, with costs. The petitioners are directed to pay a sum of Rs.2,000/-(Rupees two thousand only) to the contesting respondents, within a period of two week from today and on such payment the delay of 160 days to restore the S.A.No.1195 of 2008, is condoned.
