Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the first and second respondents to issue loan form and sanction the educational loan amount of Rs.3,30,000/- to the petitioner towards the fees which is required by the third respondent's bonafide Certificate dated 06.08.2015. ORDER

This Writ Petition has been filed to to direct the first and second respondents to issue loan form and sanction the educational loan amount of Rs.3,30,000/- to the petitioner towards the fees which is required by the third respondent's bonafide Certificate dated 06.08.2015.

2. Heard the learned counsel for the petitioner and the learned counsel for the first and second respondents.

3. The case of the petitioner is that the petitioner approached the second respondent bank for obtaining educational loan and he has also opened a joint saving bank account along with his father. The first respondent directed the petitioner to approach the first respondent. The first respondent on hearing the petitioner stated that they will not give educational loan to the Civil Engineering students. Hence the petitioner has come forward with the present Writ Petition.

The counsel for the first and second respondents have filed counter and submitted that the petitioner after getting the loan application form from the respondents Bank, has neither approached the bank nor submitted application form to avail education loan from the bank and if the petitioner approach the respondents bank with proper application and required documents, the application will be considered on merits.

5. In view of the submissions of the learned counsel for the first and second respondents, the petitioner is directed to submit his education loan application with all required documents to the respondents bank within a period of one week from the date of a receipt of a copy of this Order and on receipt of such application, the first and second respondents are directed to consider the same in accordance with law within a period of three weeks thereafter.
