Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the 1st respondent to consider and pass orders on merits in accordance with law by disposing the Statutory Appeal filed by the petitioner on 16.8.2013 by fixing time limit. O R D E R

The relief sought for in this writ petition is for a direction to the first respondent to consider and pass orders on the Statutory Appeal filed by the writ petitioner on 16.8.2013.

2.The learned counsel appearing for the writ petitioner made a submission that the disciplinary proceedings were initiated against the writ petitioner, on account of the allegation of unauthorised absence and he was terminated from service. Against the order of termination the writ petitioner preferred a Statutory Appeal before the first respondent on 16.8.2013. However, the respondent has not considered the same and no order has been passed.

3.Thus, without going into the merits of the case, the first respondent is directed to consider the Statutory Appeal filed by the writ petitioner dated 16.08.2013 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose a copy of the Statutory Appeal along with the order passed in this writ petition.

4. Accordingly, this writ petition stands disposed of. However, there is no order as to costs.
