Mr.B.Pachaiyappan, Government Counsel for R1 and R3 Order This Writ Petition has been filed to direct the 3 respondent to implement the order of the 2nd respondent dated 30.04.2025, wherein it was directed to cancel the Patta wrongly registered in the name of Sridhar / 4th respondent and restore Patta as per village records.
2. Learned counsel for the petitioner submitted that the petitioner's grandfather Thanji Goundar and 4th respondent's grandfather Natesa Goundar are brothers. They inherited the property in S.F.No.186/8, UDR patta no.910, extent 1.10.0 hectares and S.F.No.187/21, UDR patta No.911, extent 0.05.0 hectare, Kattunkanallur Village, Arani Taluk. The subject property stands jointly in the name of Tanji Goundar and Natesa Goundar and by way of succession, their legal heirs including the petitioner and the 4th respondent have been in joint possession and enjoyment of the said property. When the matter
stood thus, when the petitioner taking steps to partition the respective properties among the legal representatives, it came to know that the 4th respondent managed to get a separate patta in his name for the entire property. Hence, the petitioner made representation dated 02.03.2024 to the respondents 1 and 2 to cancel the patta and restore the property to earlier stage as two URD pattas. Since no action had taken, the petitioner filed W.P.No.33463 of 2024, wherein this Court directed the 2nd respondent to dispose of the representation. Pursuant to the said order, the 2nd respondent conducted an enquiry and passed an order dated 30.04.2025, stating that the entire land in S.F.Nos.186/8 and 187/21 was wrongly registered in the name of 4th respondent while uploading Tamilnilam software and cancelled the same and directed the 3rd respondent to upload the same in Tamilnilam software.
3. It is further submitted that the petitioner also approached the 3rd respondent to implement the order of the 2nd respondent. Since no steps being taken to implement the order, the petitioner made a representation dated 08.07.2025 to all the respondents. However, the order of the 2nd respondent is not implemented so far. Hence, the petitioner has filed this writ petition.
4. In reply, the learned Government Counsel appearing for the respondents would submit that the 2nd respondent has conducted enquiry and found that the patta has been wrongly registered in the name of the 4th
respondent and directed the 3rd respondent to take steps to issue joint patta. Pursuant to the said order of the 2nd respondent, the patta issued in favour of the 4th respondent, was cancelled and they are in the process of issuing joint patta in the name of the petitioner as well as the 4th respondent and the same will be issued within a period of two weeks.
5. Heard the learned counsel for the petitioner and the learned Government Counsel for the respondent and also perused the materials available on record.

In view of the above and recording the submission of the learned Government Counsel, this Court directs the 3rd respondent to issue joint patta in the name of the petitioner as well as the 4th respondent within a period of two weeks from the date of receipt of a copy of this order, taking into consideration the order of the 2nd respondent dated 30.04.2025.
