C.M.P.No.14658 of 2025 in C.M.A.SR.No.67586 of 2024 R. KALAIMATHI, J.
This petition has been filed seeking to condone the delay of 714 days in filing the appeal.
2.Heard the learned counsel for the petitioner. 3.Despite the receipt of notice, on behalf of the respondent, none represented.
4.The 1st petitioner would aver that her husband died and she is in financial crisis to run her day to day life. Hence, the delay of 714 days occurred in filing the appeal. Meanwhile, due to her financial condition and ill health, the said delay was caused, which is not willfull.
5. The reasons assigned by the petitioner in the affidavit appear to be reasonable and acceptable. Therefore, this Court is inclined to allow this petition, subject to the condition that the interest for the delay period of 714 days shall stand waived.
