Mr.A.Vinothraj, Standing Counsel COMMON ORDER The writ petitions are filed for the below relief: "directing the respondents to settle the interest for the belated payment of retirement benefits such as Provident fund, gratuity, Earned Leave Surrender, Commutation of Pension and other retirement benefits payable to the petitioner with 12 percent rate of interest within the time frame that may be stipulated by this Court.".
2. The brief facts which has culminated in the filing of these writ petitions are set out below:
2.1. It is the case of the petitioners that they were working as Special Grade Driver and Checking Inspector and retired from service. The respondents
settled the petitioners terminal benefits with a delay. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation to the respondents to pay the interest at the rate of 12% p.a., for the belated payment of the petitioners' Provident fund, gratuity, Earned Leave Surrender, Commutation of Pension and other retirement benefits. Since there is no response, the petitioners are before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. Admittedly, the Provident fund, gratuity, Earned Leave Surrender, Commutation of Pension and other retirement benefits has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petitions are allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident fund, gratuity, Earned Leave Surrender, Commutation of Pension and other retirement benefits within a period of one
