PRAYER : Plaint under Order VII Rule 1 CPC and Order IV Rule 1 of OS Rules praying for (a)Partition and separate possession of his 1/3rd share in all the immovable properties situate in the Districts of Chennai, Chengalpet, Coimbatore and Dindigul morefullly described in Item Nos.1 to 7 of the Schedule to this Plaint; (b) for a direction to pay mesne profits towards rental collections made from Item No.1 of the suit schedule properties.
For Plaintiff : Mr.V.Suthakar For respondents : Mr.K.V.Babu for D1 and D2 D3- Set exparte.
JUDGMENT
The learned counsel for the plaintiff and learned counsel for D1 and D2 are present.
2. The learned counsel for the plaintiff filed memo dated 15.11.2016, stating that D3 is no longer necessary party to the suit. Hence, the learned counsel for the plaintiff wants to give up D3 in this suit. Accordingly, D3 is given up. Notice was given to D1 and D2 and D3 has now been given up. The suit is dismissed as against D3 as she has given up by the plaintiff.
3. The plaintiff and D1 and D2 signed the compromise memo before the Tamil Nadu Mediation and Conciliation Centre of this Court, the compromise memo signed by the plaintiff and D1 and D2 along with their respective counsel, is recorded. The final decree is passed in terms of the compromise memo filed by the plaintiff and D1 and D2. Suit against D3 is dismissed. The joint memo dated 31.08.2016, shall form part of the decree. No costs. Consequently, connected application is also closed.
