J.NISHA BANU, J C.M.P.No.15945 of 2021 has been filed to extend the time for payment of the cost of Rs.5,000/- to the respondents in C.R.P.NPD.No.320 of 2009, dated 9/2/2021.

2. This Court, vide, order, dated 9/2/2021, has passed the following:- "4. Considering the above, the order, dated 20/7/2007 passed in I.A.No.218 of 2005 in C.M.A.Sr.No.7589 of 2005, on the file of the Subordinate Judge, Kancheepuram is set aside and the condone delay petition is allowed, on cost of Rs.5,000/- (Rupees Five thousand only) payable by the petitioners to the respondents, within a period of

two weeks from the date of receipt of copy of this order. The first appellate Court is directed to number the Civil Miscellaneous Appeal and pass orders on merits and in accordance with law within a period of eight weeks from the date of numbering the appeal."

3. Heard Mr.T.Mathi, learned counsel for the petitioners and Mr.P.Kannan, learned counsel for the third respondent.

4. Learned counsel appearing for the petitioners submitted that due to pandemic situation, the petitioners were unable to pay the cost, as directed by this Court, in time. Thereafter, when the counsel went to the residence of the counsel appearing for the respondents, to pay the amount of Rs.5,000/-, but he expressed his inability to accept the same, as there is delay in paying the cost.

5. Considering the reasons stated in the affidavit, filed in support of this petition, two more weeks time is granted, from today, to the

petitioners to pay Rs.5,000/- (Rupees Five thousand only) to the respondents.

6. Accordingly, this Miscellaneous Petition is ordered. 26/4/2022 mvs.
