ORDER

This petition has been filed to modify the condition imposed on the petitioner vide order dated 21.10.2019 in Crl.MP.No. 3548 of 2019 on the file of the Principal District and Sessions Judge, Coimbatore.

2. The learned counsel for the petitioner submits that while granting bail to the petitioner, the Principal District & Sessions Court, Coimbatore, directed the petitioner to surrender his passport before the Chief Judicial Magistrate, Coimbatore and the petitioner surrendered his passport. In the Meantime, the petitioner and his mother intended to go to Saudi Arabia for pilgrimage to Mecca and Medina, for that purpose he needs his passport to go abroad for a period of three months. Hence, he filed the petitioner before the said Court for return of passport but the same was dismissed. Therefore, the petitioner filed this petition to modify the condition and further, he submits that the petitioner's family is living in Indonesia due to non availability of passport he is not able to meet his family. Hence, filed this petition to modify the condition.

3. The learned Additional Public Prosecutor submits that petitioner's family members are living in Indonesia, if the passport is returned to him, he would not come back to our country and there is possibility for absconding.

4. Considering the facts and circumstances of the case, the petitioner want his passport for the pilgrimage purpose. Hence, this Court is inclined to give permission to the petitioner to go abroad with condition. The Chief Judicial Magistrate, Coimbatore, is directed to return the passport to the petitioner/Abdul Rahman within a week.

i. The petitioner shall execute a bond for a sum of Rs.10,000/- with two sureties each for a sum like to the satisfaction of the Chief Judicial Magistrate, Coimbatore.

ii. The petitioner shall deposit a sum of Rs.5,00,000/- before the Chief Judicial Magistrate, Coimbatore, in crime number F.No.DRI/CRU/VII/48/ENQ-01/INT-06/2019.

iii. The petitioner shall return to the country within a period of two months from the date of his departure.

5. Accordingly, this petition is ordered.
