This petition has been filed seeking a direction to transfer the case in S.T.C.No.107 of 2014 on the file of the learned Judicial Magistrate, Fast Track Court (Magisterial Level), Ambattur, to the file of the learned Judicial Magistrate, Nagapattinam.

2. It is submitted by the learned counsel for the petitioner that the respondent has filed a case in S.T.C.No.107 of 2014 against the petitioner under Section 138 of the Negotiable Instruments Act and as per the complaint, the cheque was drawn on Lakshmi Vilas bank, Nagapattinam Branch, Nagapattinam and therefore, as per the Apex Court judgment, the case has to be filed before the learned Judicial Magistrate, Nagapattinam.

According to me, it is is open to the petitioner to file an application before the learned Judicial Magistrate, Fast Track Court (Magisterial Level), Ambattur, by referring to the Apex Court judgment for transferring of the case to the concerned Court and such petition is filed, the learned Judicial Magistrate, Fast Track Court (Magisterial Level), Ambattur, is directed to consider the same and pass orders on merits within a period of two weeks. .

4. With the above observation, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is closed. Consequently, connected miscellaneous petitions are closed.
