Crl.M.P.No.8142 of 2023 in Crl.A.No.310 of 2017 SATHI KUMAR SUKUMARA KURUP,J.

Learned Counsel appearing for the Appellant has filed Crl.M.P seeking relaxation of the condition. It is the contention of the learned Counsel that at the time of admission of the appeal, he was granted bail. Pending appeal, he was directed to appear before the learned trial Judge on the first working day of every month and he had been complying the condition right from 2017 onwards. It causes difficulties. Therefore, he has come up for relaxation of the condition. The Appellant who had filed an appeal against conviction is duty bound to proceed with the appeal. Instead of proceeding with the appeal, he is seeking relaxation of the condition, ignoring the fact that he had suffered conviction. But for this interim suspension of the judgment of conviction, he would have been in prison by now. The attempt of the Appellant and the audacity seeking to relax the bail condition is not appreciated by this Court. The appellant is directed to

proceed with the appeal failing which the appeal will be dismissed and he will be detained in prison.
