ORDER
(Order of the Court was made by S.M.Subramaniam J.) The present contempt petition has been instituted to punish the respondent for her willful disobedience of the order dated 14.07.2023 passed in W.P.No.1474 of 2023.
2. The petitioner was holding the post of Senior Manager in Tamil Nadu Poultry Department Corporation Limited and retrenched from service with effect from 29.12.2000. He challenged the retrenchment order in W.P.No.2613 of 2009. The Writ Court allowed the writ petition vide order dated 04.02.2022. The said writ order was taken by way of an appeal in W.A.No.1474 of 2023. The Division Bench passed an order on 14.07.2021 affirming the Writ Court order and recorded that the petitioner had already reached the age of Page No.2 of 6
superannuation and therefore, directed to pay all the consequential benefits payable to him.

The learned Additional Government Pleader appearing on behalf of the respondent now furnished the copy of the Government order issued in G.O.Ms.No.140, Animal Husbandry, Dairying, Fisheries and Fishermen Welfare Department dated 06.08.2025 and made a submission that the order of this Court has been complied with.
4. Perusal of the Government order reveals that a disciplinary proceeding initiated on 08.02.2005, is pending against the petitioner. The petitioner reached the age of superannuation in the year 2014. The allegations are relating to misappropriation of Government funds. The said disciplinary proceedings since pending the Government passed an order allowing the petitioner to retire from service without prejudice to the disciplinary proceedings. That apart, the Government order states that the eligible monetary benefits will be settled as per the rules. Page No.3 of 6
5. The writ petition challenging the retrenchment order is unconnected to the departmental disciplinary proceedings initiated against the petitioner in the year 2005. The said disciplinary proceedings were pending and no final order has been passed, since the petitioner was retrenched from service. The petitioner was reinstatement in service. Thus, there is no impediment for the Disciplinary Authority to continue the departmental disciplinary proceedings on such reinstatement. The departmental inquiry has been conducted and the Inquiry Officer has submitted the final report before the Disciplinary Authority, who is yet pass the final order. However, the disciplinary proceedings are not the subject matter of the present writ appeal.
Thus, the petitioner has to seek all further mandatory and other benefits over and above the benefits already ordered to be granted by the Government in G.O.Ms.No.140 dated 06.08.2025, after passing final orders in the departmental disciplinary proceedings. Subsequently, the petitioner may approach the competent authority for further relief, for which, if he is otherwise entitled, under the Service Rules.

6. With these clarifications, the Contempt Petition stands closed. No costs. Consequently, the connected miscellaneous petition is also closed.
