ORDER

This petition has been filed to call for the records in M.C.No.51 of 2013 on the file of the Chief Judicial Magistrate, Vellore, Vellore District and consequently quash the same.

2. The petitioner who is an accused in the above case is the husband of the respondent and has filed this petition to quash the proceedings in M.C.No.51 of 2013 on the file of the learned Chief Judicial Magistrate, Vellore, Vellore District.

It is seen that the respondent has filed the above petition for interim maintenance against the petitioner as such the petitioner has to establish his case only before the trial court and hence this Court is not inclined to allow the prayer sought for by the petitioner.

3. However, considering the case is of the year 2013, the trial court is directed to complete the trial proceedings within a period of three months from the date of receipt of a copy of this Order.
