By consent, this Writ Petition is taken up for final disposal.
2. The petitioner is a minor represented by her guardian and next Friend Tmt. Mrs.Arasammal. It is stated by the petitioner that she had two children viz., Ramachandran and T.Rajalakshmi and her daughter was doing her plus 2 in the year 2001 and one Ravichandran, who was employed as Tamil Pandit in Government Higher Secondary School, Ottampatty, Villupuram District, has kidnapped her daughter and sexually assaulted her and made her to marry him as the second wife and she became pregnant and delivered the minor petitioner, who is now aged about 13 years. The daughter of Mrs.Arasammal was also left and married somebody leaving the minor petitioner under the custody of Tmt.Arasammal and she has no independent source of income and with great difficulty she mobilized funds for the studies of minor child.
The minor petitioner has also submitted a representation dated 26.06.2015 to the 3rd respondent, narrating the factual aspects and grievances that took place so far and further stated that she is studying 8th std., and she want to continue her studies and due to poor financial condition and difficulties she may not be in a position to continue her studies and having found that his father viz., Ravichandran was compulsory retired and she prayed for settlement of some portion of the retirement benefits in her favour so as to enable her to maintain herself and continue her studies and since no response is forthcoming, she came forward to file this writ petition.
3. Heard the submission of Mr.V.Subbiah, learned Special Government Pleader, who accepts notice on behalf of the respondents.
4. This Court, in the light of the facts and circumstances and without going into the merits of the claim, directs the respondents 1 and 2 to consider and dispose of the petitioner's representation dated 26.06.2015 on merits and in accordance with law, after putting on notice the 5th respondent and pass orders within a period of ten weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the 5th respondent.
