ORDER
This Criminal Original Petition has been file seeking a direction to the District and Sessions Judge, Tirupathur, to consider the petitioner's bail application on her surrender in connection with Crime No.25 of 2026, pending investigation on the file of the respondent Police.
2. The case of the prosecution is that the defacto complainant, who belongs to a Scheduled Caste Community, owns a land in Survey No.391/1 B1 in Ambalur Madura Kodaiyanchi Village. On 31.01.2026, when she was proceeding to her field, one Subramani, his wife Santhi and one Manjula used a JCB to damage the passage to her field, put up fencing and obstructed her access, on account of her caste. Based on the complaint, a case was registered against the petitioner.
3. The petitioner is shown as as an accused in Crime No.25 of 2026 for the offence under Sections 126(2), 326(b) of BNS and Sections 3(1)(y) and 3(1) (za)(A) and the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act. It is the contention of the petitioner that she has been falsely implicated in this case and hence, she has filed the present petition.
4. The learned Government Advocate (Crl. Side) today produced a copy of the final report filed under Section 193 of BNSS before this Court. A perusal of the same reveals that the charge sheet has been filed only against Subramani (A1) and his wife Santhi (A2) and the petitioner's name has been deleted from the array of accused and the prosecution has cited ten witnesses.
5. Considering the submissions of the learned Government Advocate (Crl. Side) and on perusal of the final report, it is evident that the petitioner's name has been deleted from the array of accused. Therefore, no further orders are required in this petition.
