The petition is filed seeking to set aside the dismissal for default order dated 10.09.2020 made in Tr.CMP.No.39/2020 and to restore the same on file.

Learned Counsel for the petitioner submitted that since he was affected by Covid-19 Corona at the relevant point of time, he was unable to appear before this Court on 10.09.2020 to represent the case, as a result, the matter was dismissed for default. Therefore, the same may be set aside.

Accepting the reason stated by the learned Counsel for the petitioner, the order dated 10.9.2020 passed in Tr.CMP.No.39/2020 is recalled and the Tr.CMP.No.39/2020 is restored on file.
