Civil Miscellaneous Second Appeal is filed under Section 28 of the Hindu Marriage Act read with under Section 100 of the Civil Procedure Code, against the fair and decreetal order dated 19.04.2012 made in C.M.A.No.38 of 2011 on the file of the Principal District Judge, Cuddalore, setting aside the judgment and decree dated 19.04.2011 passed in H.M.O.P.No.96 of 2008 on the file of the Principal Sub-ordinate Judge, Cuddalore. J U D G M E N T
The learned counsel appearing for the appellant submits that the appellant is no more and produced the death certificate of the appellant issued by the Department of Municipal Administration and Water Supply dated 27.01.2017 and also made an endorsement to that effect.
2. Recording the death certificate of the appellant issued by the Department of Municipal Administration and Water Supply and the endorsement made by the learned counsel for the appellant, this Civil Miscellaneous Second Appeal is dismissed as infructuous.
