Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorari, to call for the records relating to the charge memo No.16466/V3/2013 dated 04.04.2013 on the file of the second respondent and quash the same.

ORDER

This writ petition has been filed questioning the correctness of the charge memo dated 4.4.2013 issued against the petitioner containing four charges asking to submit his explanation. Finally the petitioner submitted his explanation denying all the charges. However, the disciplinary authority, finding that the explanation offered by the petitioner with regard to the four charges was not satisfactory, appointed an enquiry officer, who also, after completion of the enquiry, submitted his representation on 23.1.2015. In the said report, it could be seen that two charges, out of four, were found against the petitioner. However, after submission of his written representation to the report of the enquiry officer, the respondents have not come forward to pass final order. Therefore, this Court, without going to the charge memo, hereby directs the disciplinary authority to pass final orders, in the https://hcservices.ecourts.gov.in/hcservices/

light of the enquiry report along with the written representation given by the petitioner to the report of the enquiry officer, within a period of six weeks from the date of receipt of a copy of this order, on merits and in accordance with law.
