This Civil Miscellaneous Petition has been filed by the Petitioner/Claimant praying to condone the delay of 950 days in filing the above C.M.A before this Court against the order dated 18.04.2022 made in M.C.O.P.No.668 of 2017 on the file of the Motor Accident Claims Tribunal, Special District Judge Court, Erode.

2. Mr.S.Senthilkumar, learned counsel appeared on behalf of 2nd Respondent/Insurance Company submitted that he has no objection to this petition being allowed.

3. Having been satisfied with the reasons assigned in the affidavit filed in support of this petition, delay is condoned and this Civil Miscellaneous Petition is allowed.

4. It is made clear that after the numbering of this Civil Miscellaneous Appeal, if this Court enhances the compensation which was awarded by the Tribunal, Petitioner/Claimant will not be entitled to get any interest for the default period.
