The petitioners who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 420, 419, 465, 468, 471 r/w 34 of IPC, in Crime No.13 of 2022, seek anticipatory bail.
2. The case of the prosecution is that the petitioners were doing Real Estate business. The petitioners approached the defacto complainant to buy the vacant land at Periyapalayam Village, Tiruppur district. The owner of the said land is one Shanmugasundaram who was informed that the original documents pertaining to the above said land was lost at Kancheepuram. The petitioners handed over the Non Traceable Certificate for the lost original documents along with xerox copies of the parent document to the defacto complainant. Thereafter, the defacto complainant and his friend purchased the land and the name transfer in the patta was also done. At the time of cleaning and fencing the land, it was found that the said Shanmugasundaram is the owner of the land. Thereafter, the defacto complainant found that the petitioners cheated him. Hence, the complaint.
3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.
4. The learned Additional Public Prosecutor submits that the petitioners were arrested on 08.07.2022. Hence he vehemently opposed to grant anticipatory bail to the petitioners.
5. Taking into consideration the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioners.
6. Accordingly, this Criminal Original Petition is dismissed. 12.07.2022 mn
