Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to grant the time scale of pay at Rs.4800-10000 with grade pay of Rs.1300/- to the petitioners notionally with effect from the date of their appointment as Scavengers / Sweepers in the Police Department together with arrears of pay from 25.01.2018, the date on which order in W.P.(MD) No.17663 of 2014 was passed followed by the implementation order issued by the respondent in G.O.(Ms).No.50, Education, dated 08.03.2019 on par with Scavengers / Sweepers of other Departments.

The petitioner has filed this writ petition seeking issuance of a Writ of Mandamus directing the respondents to grant the time scale of pay at Rs.4,800/- - 10,000/- with grade pay of Rs.1,300/- to the petitioners notionally with effect from the date of their appointment as Scavengers / Sweepers in the Police Department together with arrears of pay from 25.01.2018, the date on which the order in W.P.(MD) No.17663 of 2014 was passed followed by the implementation order issued by the respondent in G.O.(Ms).No.50, Education, dated 08.03.2019 on par with Scavengers / Sweepers of other Departments. 2.Heard the learned counsel appearing for the petitioners and the learned Additional Government Pleader appearing for the respondents.
3.The learned counsel appearing for the petitioners would submit that the petitioners made representation dated 12.04.2019 to the respondents seeking to grant time scale of pay at Rs.4,800/- - 10,000/- with grade pay of Rs.1,300/- notionally with effect from the date of their appointment, however, till date, their representations were not considered. Hence, it
would suffice, if this Court issues direction to the respondents to consider the petitioners representation and pass appropriate orders, within the time frame fixed by this Court. 4.Considering the facts and circumstances of the case and since the petitioners made representation and the same were not considered, I am inclined to issue direction to the respondents to consider the representation of the petitioners, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
