The petition has been filed to condone the delay of 43 days in filing the application to restore the second appeal which had been dismissed, since steps had not been taken by the appellants to bring on record the legal representatives of the deceased sole respondent.

2. Heard the learned counsel for the appellants.

3. Having satisfied with the reasons stated in the affidavit filed in support of the petition, delay is condoned, the C.M.P.No.10639 of 2022 is ordered and consequently, the second appeal is also restored to file.
