A.No.3773 of 2022 is filed to condone the delay of 689 days in filing the petition to set aside the abatement in Tr.C.S.No.398 of 2020. 2.A.No.3774 of 2022 is filed to set aside the abatement in Tr.C.S.No.398 of 2020 for non filing the petition to bring the legal representatives of deceased 1st defendant R.H.Mahalakshmi.
3.A.No.3775 of 2022 is filed to bring the proposed respondents 3 to 10 as legal heirs of deceased 1st defendant R.H.Mahalakshmi as defendants 4 to 10 in Tr.C.S.No.398 of 2020.
4.It is submitted by the learned counsel for the petitioner that the third defendant namely Assistant Executive Engineer, Madurai Corporation, Madurai, was set ex-parte.

R.C.Vatchala has no objection for allowing these applications. G. CHANDRASEKHARAN.J., 6.It is submitted by the learned counsel for the petitioner that the proposed respondents are the only legal representatives of the deceased 1st defendant/R.H.Mahalakshmi and they already impleaded in Tr.C.S.No.171 of 2020. Therefore, this Court allows all the three applications and proposed respondents are ordered to be impleaded as defendants 4 to 10 in Tr.C.S.No.398 of 2020. The learned counsel for the plaintiff is directed to take appropriate steps to carryout amendment in the plaint and file amended plaint. Summons to be sent to newly impleaded defendants 4 to 10.
