O R D E R

This Criminal Original petition has been filed challenging the proceedings in STC.No.61 of 2013 pending on the file of the Fast Track Court, Nagapattinam. The respondent has filed a complaint against the petitioner for the offence under Section 138 of the Negotiable Instrument Act. The petitioner has raised the grounds before this Court to the effect that he wants to defend himself in the proceedings and the Court below has sent a notice to the effect that the petitioner can settle the entire cheque amount to the respondent and finish the case. Therefore, the petitioner is aggrieved by the summon issued by the Court below.

Since the petitioner is not interested to settle the matter, the petitioner is at liberty to defend himself before the Court below in the proceedings and the Court below shall decide the case on its own merits and in accordance with law. https://hcservices.ecourts.gov.in/hcservices/

This Criminal Original Petition is disposed of with the direction to the Court below to complete the STC.No.61 of 2013 within a period of three months from the date of receipt of a copy of this order. Consequently, connected miscellaneous petition is also closed.
