Defendants PRAYER: Plaint under Order IV Rule 1 of O.S.Rules read with Section 26 Order VII Rule 1 of C.P.C. for the following relief: (a) granting a decree of specific performance of the Agreement of Sale dated 13.12.2007 executed by the Defendants in favour of the Plaintiff by executing a registered Sale Deed in favour of the plaintiff after receiving the balance of sale consideration amount of Rs.75,00,000/- and register the sale deed at the expenses of the plaintiff and in default the sale deed be executed and registered by the officer of this Court in favour of the

plaintiff for the suit property.

(b) For a permanent injunction restraining the defednatns and their men or their agents or servants, legal representatives or any other person from selling or alienating or encumbering the suit schedule property in any manner whatsoever.

JUDGMENT

Today, when the matter is taken up for hearing, the learned counsel for the Plaintiff has submitted that this suit may be dismissed as withdrawn and half of the Court fee may be ordered to be refunded. He has also made an endorsement to that effect.

2. In view of the submission made by the learned counsel for the Plaintiff and also in view of the endorsement made, this suit

is dismissed as withdrawn. Half of the Court fee is ordered to be refunded. No costs.
